Terms of Service

By accessing or using re:lay (the "Service", "we", "us", or "our"), including any interfaces, dashboards, or tools provided herein, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease all access and use of the Service.

These Terms apply to all visitors, developers, users, and others who access or use the Service. You represent and warrant that you have the legal capacity to enter into these Terms and are at least 18 years of age.

re:lay is a developer-focused email management client and dashboard. It provides a visual interface for managing, composing, tracking, and optimizing transactional emails sent via third-party delivery services, specifically Resend, Inc. ("Resend").

re:lay is an independent application and is not officially affiliated with, endorsed by, or partnered with Resend, Inc. The Service relies on your own direct credentials (such as API keys) to connect and interact with your Resend account.

To utilize the full capabilities of re:lay, you must provide your Resend API keys. You retain full ownership and control of your credentials. re:lay stores these credentials securely (using encryption where appropriate) solely to perform actions on your behalf at your direction.

You are entirely responsible for:

• Maintaining the confidentiality of your API keys and login credentials.
• All activities that occur under your API keys or account.
• Promptly notifying us of any unauthorized use of your credentials or any other breach of security.

We will not be liable for any loss or damage arising from your failure to safeguard your API keys or unauthorized access to your account.

You agree to use the Service in compliance with all applicable local, state, national, and international laws, regulations, and treaties, including but not limited to the CAN-SPAM Act, the General Data Protection Regulation (GDPR), and all applicable electronic communication and privacy laws.

You agree not to use the Service to:

• Transmit, send, or upload unsolicited bulk email (spam), marketing messages without explicit consent, or phishing campaigns.
• Distribute malware, viruses, worms, Trojan horses, or any other destructive or disruptive code.
• Infringe upon the intellectual property, privacy, or publicity rights of any third party.
• Interfere with or disrupt the integrity, performance, or availability of the Service or third-party email infrastructure.

We reserve the right, but do not assume the obligation, to monitor usage and terminate access immediately for any user found violating these guidelines.

The Service directly interacts with Resend API endpoints. Your use of Resend's delivery platform is governed by Resend's own terms of service, acceptable use policies, and privacy policies.

We have no control over, and assume no responsibility for, the reliability, delivery success, terms, policies, or practices of Resend. You acknowledge that delivery delays, API outages, or account suspensions initiated by Resend are beyond the control of re:lay.

The Service, including its original source code, layout, design templates, graphics, and logo, is the intellectual property of re:lay and its licensors, and is protected by copyright, trademark, and other laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your professional or personal development needs. You may not copy, modify, distribute, or reverse engineer any part of our proprietary code without explicit permission.

Disclaimer: The service is provided "as is" and "as available" without any warranties of any kind.

We explicitly disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of performance. We do not warrant that the Service will function uninterrupted, error-free, secure, or meet your specific expectations.

In no event shall re:lay, its developers, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any legal action, suit, or proceeding arising out of or relating to these Terms or the Service shall be instituted exclusively in the competent courts located in Pune, India.
